Smart solutions can significantly reduce software costs

In August 2023, the Municipality of Óbuda issued a tender for the supply of the software.

At first Óbuda published their public procurement with conditions that excluded SHS (second hand software), but after our 2 clarifying questions, they withdrew it and re-published 3 months later with conditions that allowed SHS, moreover which completely complied with the jurisprudence of the CJEU.

As perpetual licenses, it must be ensured that a valid, activatable MAK key is available until the end of the extended product cycle, even in case of machine replacements or other (e.g. due to failure) necessary reinstallations.

A declaration of the availability of complete documentation (history of origin of transferred licences) in case of used software:

a) The first license purchaser purchased the licenses with the consent of the copyright holder and their use is not time-limited (perpetual licenses)

b) The first purchaser purchased the licences in an EU/EEA state.

c) The first purchaser and the previous owners have removed the licences and prevented further use - uninstallation statement(s).

d) The licence(s) have been paid for in full by both the first and previous owners.

e) The licences are not subject to third party rights.

And so, we have won the tender by giving the best price solution.

We offered the cheapest possible option by delivering licenses from the free market in full compliance with the client's requirements, including one new Exchange server license with 3-year software assurance. District Obuda saved 146 000 EUR with our legal and compliant solution.
